Apya Yoga Liability Waver and Terms and Conditions

2020 Policy Document

 

APYA YOGA (Monique Qureshi and Jay Taylor) DISCLAIMER/LIABILITY WAIVER

 

I hereby agree to the following:

 

That I am participating in the Yoga classes or any other exercise programs offered by Apya Yoga during which I will receive information and instruction about yoga, physical exercise or health. I recognise that exercise requires physical exertion, which may be strenuous and may cause physical injury, and I am fully aware of the risks and hazards involved.

 

I understand that it is my responsibility to consult a physician prior to and regarding my participation in the yoga classes, health programs or workshops offered by Apya Yoga. I represent and warrant that I am physically fit and I have no medical condition, which would prevent my full participation in these yoga classes, health programs or workshops.

 

It is my responsibility to opt out from practices at any point, which I deem unfit or unsuitable during the practice. Therefore, in consideration of being permitted to participate in the yoga sessions, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in activities offered by Apya Yoga .

 

If I am pregnant I understand that I participate fully at my own risk and that of my unborn child/children.

 

In consideration of being permitted to participate in the yoga classes, health programs or workshops, I agree to assume full responsibility for any risks, injuries or damages, known or unknown, which I might incur as a result of participating in the programs offered by Monique Qureshi and Jay Taylor.

 

In further consideration of being permitted to participate in the yoga classes, or workshops, I knowingly, voluntarily and expressly waive any claim I may have against Monique Qureshi and Jay Taylor or the instructor for injury or damages that I may sustain as a result of participating in these programs.

 

I understand that from time to time during classes, the instructor may physically adjust students’ form and posture. If I do not want such physical adjustments, I will so inform the instructor at each class I attend. I also acknowledge that if I do wish to receive such adjustments, it is my responsibility to inform the instructor when an adjustment has gone as far as I desire at that time.

 

I hereby take full and sole responsibility from any liability of loss or damage to personal property associated with yoga classes or any other events.

 

This document also includes any qualified teacher we may from time to time invite to teach.

 

I, my heirs or legal representatives forever release, waive, discharge and covenant not to sue Monique Qureshi and Jay Taylor for any injury caused by their negligence or other acts.

I have read the above release and waiver of liability and fully understand its contents.

 

Upon booking a class with Apya Yoga, I voluntarily agree to the terms and conditions stated above under my own free will.

 

 

·      Every effort is made to keep the area clear from COVID 19. We will not teach if symptoms arise within our bubble. Please abide by the same standard.

·      If you use any equipment not your own. You do so at your own risk.

Cancellation

​

Please give us as much notice as possible. To receive refund we need 12hrs notice.

NB: For SUP YOGA we require 48hrs notice for full refund at 24hrs you will receive 50% refund. Thank you for your understanding.

Additional Terms and Conditions for those booking Paddleboard Yoga.

Tittesworth Terms and Conditions 

This agreement is made between you (the customer as defined in the booking process – online and offline) and Tittesworth Water Sports Ltd, hereby referred to as us/we, and shall be formed when we acknowledge acceptance of your booking form and deposit. The contract is subject to availability of an activity place/date. 

These conditions may only be waived in special circumstances, but only in writing from us. 

When making your booking it is implied and accepted that you have read and understood all these booking conditions and agree to abide by them. 

  1. Booking Conditions 

    1. General Booking Conditions  

      1. You must complete and return to us the Booking Form – either online or offline to book your place. 

      2. The balance of your account will be payable 6 weeks in advance of the activity date. If the balance is not received by this time, we reserve the right to cancel your booking and your deposit will be forfeited.  

        1. You confirm that you are physically fit for the course or activity you have chosen.  

        2. You appreciate that the activity may be hazardous by its nature and accept a certain element of risk.  

        3. You agree to abide by such policies as we may consider advisable.  

        4. If signing as a parent/guardian you agree to your child taking part in the activity specified, accept the risks involved and have declared any medical conditions that are relevant.  

    2. Payment 

      1. We accept payments by cheque, cash or bank transfer or other such means as described on the invoice. Cheques should be made payable to Tittesworth Water Sports Ltd. 

      2. In the event of your cheque being dishonoured, a charge of £25 will be made to you to cover bank and administrative costs. 

  1. Amendments to courses or activities 

    1. Amendments to courses or activities by Us 

 .Whilst every effort will be made to adhere to the planned itinerary for your activity, it must be realised that changes to the programme can occur from time to time due to factors outside of our control and we accept neither responsibility nor liability for any associated costs, should this occur. As a consequence, we may be forced to alter dates or venues before the activity starts and we will inform you of any such changes as soon as we know of them. 

i.On assessing the conditions on the day and attendee abilities, we and our coaches may decide to alter any proposed plan or river/venue if it is believed that not doing so would put attendees at unnecessary risk. 

ii.Some activities require specific river levels, particularly when running advanced courses. We endeavour to plan courses for the time of year that we would expect to get the appropriate amount of rainfall. For water dependant activities a final decision as to the viability of the activity will be made 2 days before the activity is due to start. If an activity is cancelled at this point then you will be offered an alternative venue or date. If the subsequent date is also cancelled then customers will be given the opportunity to wait for another alternative date or have a full refund. 

    1. Amendment to courses by You 

 .If you make an alteration to a booking you must give your instructions in writing and pay a course amendment fee of £35.  

  1. General Terms 

    1. Health 

      • When participating in activities you should expect to be involved in adventurous and sometimes strenuous activities and so you should be of good general health. The medical section must be completed as part of the booking process. All prior injuries and/or serious illnesses must be declared. Any injury or illness occurring between the time of the declaration and the commencement of the activity must be reported. You must satisfy yourself that taking part in the activity is within your own capabilities. We reserve the right to refuse a booking on medical grounds if it is considered to be detrimental to the safety and smooth running of the activity. 

    1. Equipment 

      • You shall provide any necessary equipment for the activity as directed by us. 

      • We or our designated coaching staff are not under any liability whatsoever in the respect of loss or damage to your personal property, however caused, whilst attending the activity. 

      • Where we do provide any equipment for use during the activity, you shall be responsible for the safekeeping of all equipment issued. With the exception of fair wear and tear we reserve the right to charge for equipment that has been lost, damaged or misused. 

    1. Photography 

      • By participating in this activity you consent to us taking photographs or video of you for the purposes of feedback and personal development. These images remain the property of us and from time to time may be used for marketing purposes. You consent to the use of these images for marketing purposes by us or any company associated with us. If you do not consent to us using your image in this way please notify us of this in writing. 

    1. Safety 

      • Signing the booking form signifies your acceptance that the coach(es) in charge of your activity has the authority to make decisions affecting the attendees or individuals. The coach may require an individual or individuals to leave the course if they believe that a person or person’s health is at risk, if an illegal act is committed, or behaviour may become, or has been, detrimental to the safety, enjoyment or well-being of the group. 

      • Participation in adventurous activities entails some risk of injury. All staff employed by us are trained and appropriately qualified to run activity sessions and will at all times proceed in a manner to limit the risk of injury. However, you accept that accidents and injuries can happen. 

      • All bookings are made on the basis that you will observe the safety policies, notices or instructions set by us at all times. 

  1. Cancellation 

    1. Cancellation by Us  

      1. We reserve the right to cancel any activity which does not receive sufficient bookings to make it financially viable. 

      2. Whilst every attempt is made to ensure that activities actually run, we will notify you of any changes or cancellations as soon as practicable where we believe on reasonable grounds that cancellation is necessary due to dangerous and/or unsuitable conditions for the activity.  

      3. We shall notify you of any cancellation no less than 48 hours prior to the commencement of the activity where numbers as a result of either customer(s) cancellation or booked numbers have failed to reach a workable minimum. In such circumstances we will not refund travel costs that you may have incurred prior to the cancellation and since lost except in the circumstances set out in the clauses above.  

      4. In the event of cancellation you will be offered the choice of either another booking on a different date or if mutual dates cannot be agreed, a full refund of the fee paid.  

    2. Cancellation by You 

      1. Your deposit is non-refundable. 

      2. You understand that if you cancel your booking 6 or more weeks prior to the start of your activity, we will issue a credit note for any balance on your account which can be used on alternative courses provided by us.  

      3. You understand that if you cancel or amend your booking within 6 weeks prior to the start of your activity and if your place cannot be filled then you will be liable for the full activity fee.  

      4. If you fail to attend an activity or are required to leave an activity at any stage, for whatever reason, you will not be entitled to any refund unless agreed by us. 

  2. Corona Virus Activity Cancellation Terms and Conditions 2020 

Cancellation by Us 

      • We reserve the right to cancel any form of activity if it is by specific recommendation of the UK Government to do so in order to reduce the spread of the virus. 

      • We shall notify you of any cancellation no less than 48 hours prior to the commencement of the activity. 

      • In the event of cancellation you will be offered the choice of either another booking on a different date or if mutual dates cannot be agreed, a full refund of the fee paid. 

Cancellation by You 

      • For bookings made before the 17/03/20 with an activity date before 31/05/20 an agreed alternative activity date later on in 2020 or 2021 will be made between both parties. 

      • If your booking is from 01/06/2020 please see our general booking terms and conditions.    

      • For bookings made after the 17/03/2020 our general booking terms and conditions apply. 

      • If you fail to attend an activity or are required to leave an activity at any stage, for whatever reason, you will not be entitled to any refund unless agreed by us. 

Please note the above terms and conditions maybe amended based on the severity of the Corona Virus in the UK and recommendation from Health Officials. Last Updated 17/03/20. 

  1. Data Protection 

All information passed to us will be treated as confidential and will only be passed to third parties with your prior consent. You agree that information will be passed to our designated staff, affiliates or British Canoeing and other National Governing Bodies as is appropriate for the running and certification of activities.
